Preamble and operator identity
The « CART'IN » platform (hereinafter « CART'IN », « the Platform », « the Company » or « We ») refers collectively to its website accessible at www.cart-in.mu, its mobile applications for smartphones and tablets, its browser extensions, and its marketplace. The Platform is operated by Manoova Ltd, an official Amazon partner in Mauritius, with its registered office at B42 MORC Raffray Le Hochet, Terre Rouge 21504, Port Louis, Mauritius.
These Terms of Use (hereinafter the « Terms ») govern access to and use of the Platform by any person who accesses, registers on, or uses it (hereinafter the « User » or « You »). They are separate from the Terms and Conditions of Sale (TCS), available at www.cart-in.mu/terms, which govern purchase, payment, shipping, customs clearance, and delivery transactions. These Terms relate exclusively to use of the service.
Article 1 — Purpose of the service
CART'IN is a service that enables Users to facilitate the ordering, payment, shipping, customs clearance, and delivery in Mauritius of products offered on partner platforms, e-commerce sites, and marketplaces, including Amazon. These Terms define the conditions under which the User may access and use the Platform, independently of any purchase transaction.
Article 2 — Acceptance of the Terms
Access to and use of the Platform imply full, complete, and unreserved acceptance of these Terms, without requiring a handwritten signature. If You do not accept these conditions, You must immediately stop using the Platform. The User declares that they have the legal capacity to contract or validly represent the natural or legal person on whose behalf they act.
The Company reserves the right to amend these Terms at any time by publishing a new version on the Platform. The Terms in force are those applicable on the date of connection or use. It is the User's responsibility to review them regularly.
Article 3 — Account access and registration
Use of the Platform's features is reserved for duly registered Users. Registration requires a valid email address and phone number. Legal entities must also provide a valid and verifiable Business Registration Number (BRN) or Tax Account Number (TAN). The Company reserves the right to refuse registration at its sole discretion.
The User is solely responsible for keeping their login credentials confidential and for any activity carried out from their account. They undertake to provide accurate information and keep it up to date, and to promptly inform the Company of any unauthorized use of their account. The Company shall not be held liable for consequences arising from disclosure of credentials attributable to the User.
Article 4 — Acceptable use
The User agrees to use the Platform in accordance with its intended purpose, applicable Mauritian law, and these Terms. In particular, they must not:
- use the Platform for fraudulent, illegal purposes, or in a way that infringes third-party rights;
- order products that are prohibited or regulated for import into Mauritius;
- attempt to access the Company's systems, servers, or networks without authorization, or disrupt their operation;
- introduce viruses, malicious code, or any device likely to harm the Platform;
- abuse or fraudulently use gift vouchers, promo codes, or referral systems;
- extract, reproduce, or reuse Platform content without authorization;
- behave in an uncivil or abusive manner toward the Company's staff.
Any failure by the User to comply with their obligations may result in suspension or termination of their account, without prejudice to any damages the Company may seek.
Article 5 — Intellectual property
All elements of the Platform, whether visual or audio, are protected under copyright, trademark, or patent law and remain the exclusive property of the Company. No transfer of intellectual property rights is granted under these Terms. Any reproduction, modification, or total or partial use of these elements is strictly prohibited without prior written express authorization from the Company.
As an Amazon affiliate partner, certain product images are displayed via the Amazon API in accordance with affiliate program guidelines and are not hosted on the Company's servers.
Article 6 — Service availability and liability
The Company endeavours to provide continuous access to the Platform but does not guarantee uninterrupted or error-free operation. Access may be temporarily suspended for maintenance, updates, or in cases of force majeure, without the Company's liability being engaged. The Company's liability shall not be engaged for indirect damages resulting from use of, or inability to use, the Platform.
Article 7 — Suspension and termination
The Company may suspend or terminate a User's access, without notice, in the event of a breach of these Terms, fraudulent behaviour, or any use contrary to the law. The User may at any time request closure of their account by contacting Customer Service.
Article 8 — Personal data
The processing of the User's personal data is governed by the Privacy Policy, available at www.cart-in.mu/privacy, which forms an integral part of these Terms.
Article 9 — Governing law and competent jurisdiction
These Terms are governed by Mauritian law. In the event of a dispute relating to their interpretation, performance, or validity, an amicable solution shall be sought as a priority. Failing that, the competent court is the court having jurisdiction over Manoova Ltd's registered office.

Article 11 — Relationship with Amazon.com, Inc.
Cart'In is a brand operated by Manoova Ltd, an independent company with its registered office in Port Louis, Mauritius. Manoova Ltd is not a subsidiary of Amazon.com, Inc. Manoova Ltd holds a partnership agreement allowing it to:
- use the « Official Amazon Reseller » badge in its communications;
- place orders on Amazon on behalf of its Members;
- display product images via the Amazon API in accordance with the affiliate program.
Cart'In transactions are entered into between the Member and Manoova Ltd. Amazon® is a registered trademark of Amazon.com, Inc., used under contractual authorization.
